Health Attestation and Waiver
The undersigned attests that they are healthy and fully physically able to participate in the activities offered by PKL Park, including an exercise or sports regimen of their choosing, without undue risk of injury or other loss.Membership Payments
a) The undersigned agrees to pay the initiation and monthly membership fees outlined. The initiation fee and the first month's membership fee shall be billed on the commencement date of membership to the credit or debit card provided. From the second month of membership onward, the monthly fee will be billed on an automatic recurring basis on the day of the month corresponding to the commencement date of membership, unless the membership is canceled. If the billing date does not occur every month (for example, the 31st), billing will occur on the last day of the month instead. All membership payments are non-refundable.
b) You may be asked to provide a payment method (such as a credit, charge, or debit card number) that we accept, along with other payment information. You represent and warrant that you have the legal right to use the payment method(s) provided. Your authorizations also apply to our payment processors and other companies acting as billing agents for us. You authorize us to charge your specified payment method on a monthly basis, in advance, for your membership(s) and/or place a hold on your payment method for any unpaid charges. You authorize the issuer of your selected payment method to pay any amounts described without requiring a signed receipt. These Terms and Conditions will serve as authorization for such charges. You agree to provide updated payment information upon request if the previous information becomes invalid. PKL Park and its agents will not be liable for any insufficient funds or charges incurred by you due to payment processing.
Third-Party Payment Processors: You agree to pay us, through our payment processors, all charges at the prices then in effect for any purchases, per the applicable payment terms presented at the time of purchase. You agree to make payment using the payment method provided during account setup. We reserve the right to correct or instruct our payment processors to correct any errors or mistakes, even if payment has already been requested or received.
Bill Inquiries and Refunds: If you believe you have been billed in error for a membership, please notify us within 60 days of the billing date by contacting info@pklparkgvl.com. We will not issue refunds or credits after the expiration of this 60-day period, except where required by applicable law.Access and Use
a) Membership amenities, offers, and services (including pricing for such amenities) are subject to change. Changes will not go into effect until the first day of the subsequent month.
b) Members must be present for membership benefits to apply. Repeated infractions may result in termination of membership.
c) Members and their guests must sign PKL Park’s waiver form before participating in the activities offered by PKL Park and may be asked to sign additional waivers for subsequent visits. PKL Park reserves the right to revoke access to members and their guests for failing to sign the waiver when asked.
d) Members will strictly abide by all posted codes of conduct, safety guidelines, and regulations while using PKL Park's facilities. PKL Park reserves the right to revoke any person's membership if any of the terms of this agreement or any facility rules are violated, or if there is any concern regarding the health or safety of any person or the integrity of any property.Cancellation Rights
If you would like to cancel your membership, email us at info@pklparkgvl.com at least 48 hours before your next Billing Day. If you email us to cancel within 48 hours of your next Billing Day, your cancellation will not be effective until the following month, and you will be charged on the next Billing Day. Subject to your rights under consumer laws, your recurring payment is non-refundable. This can only happen after the minimum membership period, if applicable.Disclaimers and Limitations on Liability
a) In consideration of the privilege of using PKL Park's facilities and amenities, the undersigned and their guests hereby release PKL Park, its affiliates, and their respective owners, officers, directors, agents, employees, and assigns (collectively, the “PKL Park Releases”) from all losses and damages (including those caused by actions of the PKL Park Releases), and for all claims, suits, payments, and judgments, including legal fees, arising from personal injuries, including death, and all damage to personal property resulting from the use of PKL Park’s facilities and amenities, except to the extent directly caused by the negligence of the PKL Park Releases.
PKL Park will not be liable for any exemplary, special, punitive, or consequential damages, including any loss or damage of lost profits, revenues, or business opportunities, from any claim or dispute or any other source derived.
